REALTOR® vs. Real Estate Agent: What Is the Difference?
A practical guide for homebuyers and sellers in Virginia Beach and Hampton Roads from The Morton Group with AtCoastal Realty.
When you are choosing someone to help with a home purchase or sale, titles can blur together. Agent, broker and REALTOR® appear on signs and business cards, but they describe different things. Understanding the distinction helps you ask better questions before you sign a representation agreement.
The difference starts with membership
A real estate agent holds a state license to provide real estate services. In the context of buying and selling homes, a REALTOR® is a licensed professional who also belongs to the National Association of REALTORS® (NAR) and commits to its Code of Ethics. REALTOR® is a membership designation, not a separate Virginia real estate license. NAR explains the distinction here.
Ethics matter for every licensee
Being outside NAR does not mean an agent is free from duties or is unethical. Virginia law requires buyer and seller representatives to meet obligations that include ordinary care, confidentiality subject to legal exceptions, and specified disclosures. It also requires honest treatment of the other side. NAR membership adds an association Code of Ethics; it does not replace the law. What the REALTOR® Code of Ethics covers
The 2026 Code addresses protecting clients' interests while treating others honestly, avoiding misleading property representations, competence within the services offered, and truthful advertising. Its obligations can go beyond legal requirements, but the law takes precedence if there is a conflict. These are professional responsibilities, not a guarantee of a particular sale price or a trouble-free transaction.
For a consumer, the useful question is how those standards show up in the work: accurate marketing, clear explanations, careful handling of information and timely communication when a decision matters.
Five questions to ask before choosing your representative
- Is your Virginia license current, and are you a REALTOR®? Verify the license through Virginia DPOR's License Lookup and ask about association membership separately.
- Who will represent me, and what will our agreement say? Ask the agent to explain the services, duration, compensation, exclusivity and termination provisions in plain language before signing.
- How will you help me evaluate this specific property? For a Hampton Roads home search, ask how you will investigate flood information, insurance, condominium or HOA documents, and the limits of what an agent can assess.
- What is your communication plan? Agree on who answers questions, how updates arrive and what happens when an offer or inspection deadline approaches.
- Can you show examples of your process? Ask for a sample pricing analysis, marketing plan or buyer checklist, and read recent client feedback. Compare the work as well as the title.
Choose the person and the process
Membership is one useful piece of information. Your decision should also consider relevant experience, responsiveness and whether the proposed services fit your needs. Ask direct questions, look for clear answers and choose someone who helps you understand the tradeoffs.
